Key Issues Covered

The committee provides a forum for collaboration, discussion and guidance on issues affecting the medical malpractice market. It was created to focus on the unique risks of the market, such as changes in healthcare regulations, rising litigation and claims trends.

Education, legal and claims guest speakers

The Medical Malpractice Committee actively invites guest speakers with expertise in legal and claims matters to share their insights on emerging risks and industry trends. These sessions reinforce the committee’s dedication to ongoing education, ensuring that the market remains well-informed, adaptable and proactive in addressing evolving challenges.

Wordings redrafts

The committee is working on a revised version of LSW228/229 to achieve standardised non-US wording. Its aim is to create a clear, uniform wording suitable for non-US territories, where legal systems and healthcare frameworks differ significantly from the US.

Claims and loss trends

Claims and loss trends in medical malpractice insurance have evolved significantly in recent years, reflecting changes in healthcare delivery, patient expectations and legal environments. The committee have developed a Large Verdicts and Settlements Tracker spreadsheet of large claims in the public domain to assess emerging trends.

Working groups

The International Healthcare Wording Working Group has been established to develop an international Excess Health Care Providers’ Liability Policy, with the goal of creating an updated, standardised wording for global markets.
