The International Liability Business Panel met on 9th July 2026 to review key wording initiatives, claims trends and emerging liability risks. Progress continued on the Bodily Injury Index project, including new data visualisation work, international briefing sessions, and development of a currency conversion tool for the platform. Members discussed Long-Term Agreement (LTA) wordings, favouring alignment between primary and excess layer policies, while work also progressed on advertising liability wording issues and AI definitions guidance. Significant attention was given to the governing law paramount clause, with concerns that it could broaden coverage by overriding carefully drafted exclusions. Updates were provided on Brazilian insurance regulatory developments, claims cooperation clauses and emerging claims risks, including PFAS, ethylene oxide, municipality claims and ultra-processed food litigation. The panel also reviewed AI-related loss scenarios, litigation funding developments and plans for a 2026 symposium.
