Medical Malpractice Committee – 03 February 2026

The committee discussed emerging market considerations relating to artificial intelligence, including potential wording approaches, claims scenarios, aggregation issues and the importance of governance and human oversight. Members noted that AI use in healthcare remains largely supportive at present, but autonomous decision-making and systemic exposure may present future challenges.

The committee also received an update from Lloyd’s on casualty market performance, data strategy and benchmarking. Discussion covered rate adequacy, international diversification, pressure on terms and conditions, and the use of Lloyd’s Insights Hub data to support peer comparison and performance analysis. Medical malpractice was noted as currently showing a positive outlook, although concerns remain around long-tail development, social inflation and the reliability of ultimate assumptions.

Public-domain claims developments and legal trends were reviewed, including significant US settlements, emerging detransitioning claims and proposed tort reform. Members also discussed potential future engagement on life sciences business and external speaker opportunities.
