Cyber war clauses
Following Lloyd’s Bulletins Y5381 and Y5433 confirming Lloyd’s requirements regarding state-backed cyber attack exclusions, the LMA has been offering clause compliance and classification assessments for market participants developing their own clauses. The LMA will continue to provide this service to both members and non-members and new clauses can be submitted for consideration.
The LMA can confirm that the clauses published here were assessed by us as compliant with the Lloyd’s requirements at the time the clause was submitted and have been classified within one of the categories of clauses defined by Lloyd’s. Underwriters should therefore be able to use or follow type 1, type 2, type 3 and type 5 clauses knowing that the cyber language is compliant with the Lloyd’s requirements.
Cyber model clauses
Lloyd’s issued Bulletin Y5258 in 2019, setting out a new requirement for all contracts written in Lloyd’s to include a provision that addressed cyber risk. To assist LMA members in complying with this requirement, the LMA has produced a large suite of model cyber clauses.
The below table lists all current LMA model cyber clauses, listed by class of business and risk code, with each clause allocated to one of the following clause types:
- affirmation
- affirmation and limited exclusion
- exclusion and limited write-back
- exclusion.
This table is updated regularly by the LMA team. All LMA model cyber clauses can be found on the LWR.
Covid/disease clauses
The LMA has published a number of communicable disease clauses for use across a range of classes of business. This table lists the clauses according to whether they are for use on marine or non-marine business.
